Code of Student Conduct

BONNEVILLE SCHOOL DISTRICT 93 CODE OF STUDENT CONDUCT 

 

DRESS AND GROOMING CODE
Student dress and grooming are basically the responsibility of the student and his/her parents. Nevertheless, dress and grooming that disrupts the learning process or endangers the health or safety of the school community become a disciplinary matter.

 

STUDENT RESPONSIBILITIES:

 

  1. To keep dress and grooming clean, healthy, sanitary and safe.
  2. To follow dress and grooming standards established by school authorities for participating in school activities.
  3. To wear clothing that does not disrupt the favorable learning atmosphere or decorum of the school.

    The following are not acceptable:
    See-through clothing;
    Clothing which permits excessive exposure of bare skin;
    Clothing which displays profane, vulgar or suggestive images or slogans;
    Excessively tight or revealing clothing.
    Wallet chains, chains and spiked jewelry are not allowed

 

STUDENT RIGHTS:
Each student has the right to:

 

  1. Be informed of the school dress and grooming code at the beginning of each school year.
  2. Appeal judgments of inappropriate dress and/or grooming.

 

CLASSIFICATION OF VIOLATIONS
Violations of the Code of Student Conduct are grouped into three classes - minor, intermediate and major. Each classification is assigned a disciplinary procedure which is to be followed by the administrator or designee, who shall hear the student's explanation and consult further with school personnel, if necessary, before determining classification of the violation.

Each teacher will deal with classroom disruption with in-class disciplinary action, by a call to parents or guardian, and/or through conferring with parents or guardian and other school staff. Only when the action taken by the teacher is ineffective or the disruption sufficiently severe should the student be referred to the administrator or designee for formal disciplinary action.

 

MINOR OFFENSES - CLASS I

 

  • 1.01 - ASSAULT OR HARASSMENT OF STUDENT. The intentional, unlawful threat by word or act to do violence to another student, combined with an apparent ability to do and doing some act which creates a well-founded fear in the person that such violence is imminent.
  • 1.02 - INTENTIONALLY PROVIDING FALSE INFORMATION TO A SCHOOL BOARD EMPLOYEE. Including, but not limited to, student informational data and information directly related to school business.
  • 1.03 - USING PROFANE OR OBSCENE LANGUAGE, CONDUCT AND/OR GESTURES.
  • 1.04 - ILLEGAL ORGANIZATION. See page 11
  • 1.05 - TARDINESS. Repeatedly reporting late to school or class. Tardy Policy/see page 7
  • 1.06 - NONCONFORMITY TO DRESS CODE.
  • 1.07 - INAPPROPRIATE PUBLIC DISPLAY OF AFFECTION.
  • 1.08 - EXCESSIVE DISTRACTION OF OTHER STUDENTS. Any behavior which disrupts the orderly educational process in the classroom or other school functions.
  • 1.09 - ANY OTHER VIOLATION WHICH THE ADMINISTRATOR OR DESIGNEE REASONABLY DEEMS TO FALL WITHING THIS CATEGORY.

 

CLASS I DISCIPLINARY ACTION
First Offense: In-school conference and parental contact, when warranted.
Specific circumstances may warrant disciplinary action outlined under subsequent offenses.
Subsequent Offense: In-school disciplinary action, such as probation, detention, extra assignments, in-school suspension, suspension, at the discretion of the administrator or designee. Special circumstances may require a referral to the Superintendent of designee.

 

INTERMEDIATE OFFENSE -- CLASS II

 

  • 2.01 - BATTERY UPON STUDENTS. Unlawfully using physical force or striking another student against the will of the other, or intentionally causing bodily harm to an individual.
  • 2.02 - DEFIANCE OF SCHOOL BOARD EMPLOYEE'S AUTHORITY. Any verbal or non-verbal refusal to comply with a lawful direction of a School Board employee or volunteer worker.
  • 2.03 - USE OF OBSCENE MANIFESTATIONS, VERBAL, WRITTEN OR GESTURES, TOWARD ANOTHER PERSON.
  • 2.04 - SIMPLE ASSAULT ON SCHOOL BOARD EMPLOYEE. The intentional, unlawful threat by word or act to do violence to the person of an employee, coupled with an apparent ability to do so, and the doing of some act which creates a well-informed fear in such person that violence is imminent.
  • 2.05 - UNJUSTIFIED ACTIVATION OF A FIRE ALARM SYSTEM.
  • 2.06 - STEALING, LARCENY, PETTY THEFT. The intentional, unlawful taking, concealing, and /or taking away of property values at less than $100 belonging to, or in the lawful possession or custody of, another.
  • 2.07 - POSSESSION OF STOLEN PROPERTY. With the knowledge that it is stolen.
  • 2.08 - TRESPASSING. Willfully entering or remaining in any structure, conveyance, or property without being authorized, licensed or invited; including students who are suspended from school; or having been warned by an authorized person to depart, refusing to do so. Trespassers could be charged criminally.
  • 2.09 - VANDALISM. Intentional action resulting in injury or damages of less than $100 to public property or the real or personal property of another.
  • 2.10 - FIGHTING. Any physical conflict between two or more individuals.
  • 2.11 - POSSESSION AND/OR IGNITING OF FIREWORKS, ON GROUNDS OR IN BUILDING.
  • 2.12 - THREATS, EXTORTION. Verbally or in writing maliciously threatening injury to the person, property or reputation of another, with the intent to extort money or any pecuniary advantage whatsoever; or with person, to do any act or refrain from doing any act against his/her will.
  • 2.13 - UNLAWFUL OR OFFENSIVE TOUCHING OF ANOTHER PERSON.
  • 2.14 - WRITTEN OR VERBAL REFERENCE TO OR PROPOSITIONS TO ENGAGE IN SEXUAL ACTS.
  • 2.15 - INCITING TO RIOT OR UNAPPROVED ASSEMBLY.
  • 2.16 - UNAUTHORIZED ABSENCE FROM CLASS OR SCHOOL.
  • 2.17 - ANY OTHER VIOLATION WHICH THE ADMINISTRATOR OR DESIGNEE REASONABLY DEEMS TO FALL WITHIN THIS CATEGORY.

 

CLASS II DISCIPLINARY ACTIONS
First Offense: In-school suspension and/or extended work assignments before or after school and/or suspensions for 1-3 days.

Subsequent offenses: Suspension for 3-5 school days. Special circumstances may warrant a recommendation for expulsion. If so recommended, the expulsion procedures listed will be followed.

 

MAJOR OFFENSES -- CLASS II

 
3.01 - AGGRAVATED BATTERY.

    • Intentionally causing bodily harm, disability, or permanent disfigurement: use of a deadly weapon


3.02 - DISCHARGING ANY PISTOL, RIFLE, SHOTGUN, AIR GUN OR SUCH DEVICE.

    • Example: Stink Bomb


3.03 - POSSESSION OF WEAPONS.

    • A knife of any description metallic knuckles; tear gas gun; chemical weapon or device; or any weapon, instrument or object, which alludes to the intent to be armed. Any toys resembling a weapon.


3.04 - DRUGS.

    • Unauthorized possession, transfer, use or sale of drugs, drug paraphernalia, alcoholic beverages, tobacco products or paraphernalia. This is an automatic court referral.


3.05 - BATTERY UPON SCHOOL DISTRICT EMPLOYEE.

    • The actual unlawful, intentional use of physical force or striking of a School Board employee against his/her will, or the intentional causing of bodily harm to a School Board employee.


3.06 - ARSON.

    • The willful and malicious burning of any part of a building or its contents.


3.07 - STEALING, LARCENY, GRAND THEFT.

    • The intentional, unlawful taking, concealing and/or carrying away of property valued at $100 or more belonging to, or in the lawful possession or custody of, another.


3.07.1 - ROBBERY.

    • The taking of money or other property which may be the subject of larceny from the person or custody of another by force, violence assault, or putting in fear of the same.


3.07.2 - BURGLARY OF SCHOOL PROPERTY.

    • Entering or remaining in a structure or conveyance with the intent to commit an offense therein during the hours the premises are closed to the public.


3.08 - CRIMINAL MISCHIEF.

    • Willful and malicious injury or damages at or in excess of $100 to public property, or to real or personal property belonging to another.


3.09 - EXPLOSIVES.

    • Preparing, possessing or igniting on School Board property explosives likely to cause serious bodily injury or property damage.


3.10 - BOMB THREATS.

    • Any such communication to a School Board employee which has the effect of interrupting the educational environment.


3.11 - SEXUAL ACTS.

    • Acts of a sexual nature, including but not limited to, battery, intercourse, attempted rape, or rape.


3.12 - POSSESSION OF FIREARMS.

    • Any firearm which will, or is intended to, or may readily be converted to, expel a projectile by the action of an explosive; the frame or receiver of any such weapon; any firearm muffler or firearm silencer; any destructive device.


3.13 - ANY OTHER OFFENSE WHICH THE ADMINISTRATOR OR DESIGNEE MAY REASONABLY DEEM TO FALL WITHIN THIS CATEGORY

 

CLASS III DISCIPLINARY ACTIONS
Suspension and recommendation for expulsion by the school administrator, as authorized in the procedures outlined. Pending final determination of the matter by the School Board, the school may extend the suspension or add five (5) days.

 

DISCIPLINARY ACTIONS FOR TRUANCY

  • First Offense: Parents or guardian will be notified of attendance problems and the consequences of habitual truancy.
  • Second Offense: Informal suspension proceedings may be initiated. School officials will inform parents or guardian of such remedy as they require and of the consequences of possible future truancy.
  • Subsequent Offenses: The school administrator or designee will notify parents or guardian, and initiate full suspension proceedings. At the suspension hearing, the student is required to appear with parents or guardian and the school administrator or designee to consider action to be taken. If the student is under age sixteen (16) he/she may be referred to the courts. If the student is sixteen (16) or over, the administration may question the necessity of keeping that student enrolled in school.
